CarFax, aka CarFraud, false claims of illegal acts

This is opinion based on the facts and information that exists regarding this matter. The response from CarFax, aka CarFraud has been lacking to say the least.

I saw a link to a web page which allows you to check the odometer status of a vehicle and when I entered the VIN for my vehicle which legally had the speedometer and odometer replaced it FALSELY claims "Odometer fraud has been reported to CARFAX" which is a FALSE claim of illegal activity, which is libel.

This seems to be advertising hype in order to help sales to try to convince people to BUY a CarFax, aka CarFraud report. The proper thing to say is that there MIGHT be an issue with respect to the odometer and to ensure that if the odometer was replaced that it was legally documented, and to NOT just falsely accuse an owner of committing a crime. But this doesn't serve to sell their fraudulent vehicle reports as well. Yes, their vehicle reports are fraudulent due to FALSE claims such as in this case that there was odometer fraud when in fact there was none and instead the odometer was LEGALLY replaced.

In this case the replacement part was bought new from a dealer, which since it was new had zero miles on it and it included a sticker which is required to be put on the vehicle. As required by law, the "VEHICLE INFORMATION AND COST SAVINGS ACT" notice sticker which states "ODOMETER READING PRIOR TO REPAIR OR REPLACEMENT", "DATE OF REPAIR OR REPLACEMENT", "Effective January 20th 1973 this notice must be attached to the Left Door Frame of the Vehicle if repair or replacement has been made on the Odometer." and "Removal of this notice is Unlawful". It has a place to write the previous odometer, as well as the date. It really can't be run through a printer, so it has to be hand written, which CarFax, aka CarFraud seems to have an issue with as they claim that they cannot accept any handwritten notes/service records.

There is NO LEGAL REQUIREMENT that a person get the odometer replaced by the dealer or mechanic, it is perfectly legal for the owner of the vehicle to replace it themselves or even to get a friend to help them as long as the required notice is placed on the vehicle.

I sent information, which really I wasn't required to send, and then they replied that I needed to send the documents which I already sent in. It seems that they don't pay attention to what they have already received. I even sent a photo of the old speedometer/odometer which has the previous miles on it which documents when it was replaced. I suspect that most cases of odometer fraud the mileage is reduced, NOT reset to ZERO miles. The mileage going to ZERO is an indication that the odometer was REPLACED and NOT FRAUD.

Then they demanded additional documents, which really are not required, such as "the official Repair Order documentation from the shop where the services were performed". Again, what if the owner of the vehicle replaced it themselves? People do work on their own vehicles.

What is amazing, just not in a good way, is that they demanded "Please make sure that document indicate that the odometer cluster was replaced and what the old mileage was and what the new mileage was at the time." yet that was already provided to them NUMEROUS times.

I suspect that they are just being dishonest and are playing games to try to get me to give up trying to get them to correct their FALSE information. The responses have been from Peter V. claimed to be a "Resolution Specialist", yet he has not been able to resolve anything other than that they don't pay attention, like to provide people with false information and just not provide ANY customer service.

What should occur is that they should provide me PROOF, as I have requested, to back their claim that Odometer fraud has been reported to them.

Their false claims harm people by making it harder to sell a vehicle which has legally had the odometer replaced. People might use their bogus web page and see the false claim that odometer fraud has occurred and then not ask any questions and instead stop all interest in the vehicle. It can also cause people to offer less money for the vehicle.

As said, falsely claiming that a crime occurred is LIBEL and it causes harm to people. In addition, this PROVES that you can't trust what CarFax, aka CarFraud says.

BTW, there are cheaper places to by a vehicle report than CarFax, aka CarFraud and while it might come from the same source, at least they get less money.
